TruePresence ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our services.

Mobile Messaging and SMS Information
This section describes how Mindspirit LLC d/b/a TruePresence ("TruePresence") collects, uses, and shares information in connection with our SMS / text messaging service, including SMS-based two-factor authentication ("2FA"). It supplements, and is part of, this Privacy Policy. See also our SMS Terms of Service.
Information We Collect
When you enroll in our SMS Service, we collect:
- Mobile phone number — the number you provide for authentication.
- Consent records — the date, time, method, and IP address associated with your opt-in, and any subsequent opt-out, change, or re-enrollment.
- Message delivery metadata — including timestamps, delivery status, carrier, and error codes, as reported by our SMS provider.
We do not collect or transmit Protected Health Information (PHI) through SMS. The contents of SMS messages from TruePresence are limited to authentication codes and account security notices.
How We Use SMS Information
We use mobile phone number and related opt-in information solely to:
- Send two-factor authentication codes and account security alerts at your request.
- Verify your identity when you sign in, reset a password, or perform sensitive account actions.
- Maintain records of consent and opt-out as required by the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and applicable law.
- Diagnose deliverability issues and prevent fraud or abuse of the SMS Service.
How We Share SMS Information
No mobile information collected in connection with the SMS Service — including phone numbers, opt-in consent, or message content — will be shared with third parties or affiliates for marketing or promotional purposes.
All categories of information sharing described elsewhere in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We may share SMS-related information only with:
- Our SMS service provider (Twilio Inc.), which transmits messages on our behalf under a service agreement that restricts use of the data to delivery of our messages.
- Subprocessors that support our core services, such as fraud detection or customer support providers, under written agreements that prohibit secondary use of the data.
- Law enforcement or regulators, where required by law, valid legal process, or to protect the rights, property, or safety of TruePresence, our users, or others.
We do not sell, rent, lease, or otherwise transfer mobile phone numbers or SMS opt-in information to data brokers, marketers, affiliates, or any other third party for their own use.
HIPAA Considerations
TruePresence operates as a Covered Entity and/or Business Associate under HIPAA, depending on the deployment. Because SMS is not an encrypted channel, TruePresence restricts SMS content to non-PHI authentication codes and account security messages. Communications containing PHI are delivered through the secure, authenticated TruePresence platform, not by SMS.
Data Retention
We retain SMS-related information (phone number, consent records, and delivery metadata) for as long as your account is active and for the period required to maintain proof of consent and opt-out as required by TCPA, CTIA, and carrier regulations (generally at least four years), and to comply with our legal, audit, accounting, tax, and regulatory obligations. When retention is no longer required, we delete or de-identify the information.
Your Choices
- Opt out at any time by replying STOP to any SMS from TruePresence. You may also disable SMS-based 2FA from your account security settings.
- Switch authentication methods to an authenticator app or other supported 2FA method at any time without losing access to your account.
- Request access, correction, or deletion of your information by contacting privacy@truepresence.com.

Disclosure of Your Information
We may share information we have collected about you in certain situations:
- With service providers who assist in our operations (payment processors, email services)
- To comply with legal requirements or respond to lawful requests
- To protect our rights, privacy, safety, or property
We do not sell, rent, or trade your personal information to third parties for their marketing purposes.
Data Security
We use administrative, technical, and physical security measures to protect your personal information. While we have taken reasonable steps to secure the information you provide, please be aware that no security measures are perfect or impenetrable.

TruePresence does not sell, rent, or share your personal information with third parties for their direct marketing purposes.
